What you are entitled to

Under the EU Late Payment Directive a business invoicing another business can claim interest at least eight percentage points above the central bank reference rate, from the day after payment was due, with no need to have warned them first. On top of that there is a fixed recovery fee — €40 in most member states — per late invoice, owed simply because it was late.

How it is calculated

Simple interest on an actual/365 basis: amount, times the annual rate, times days late, divided by 365. Not compounded — most member states do not allow compounding on commercial debt without an explicit agreement. The reference rate is editable because it moves; put in the current one for your currency.

What to do with the figure

Claim it. Most freelancers never do, which is precisely why late payment is free for the client. Naming the number in a reminder changes the arithmetic of ignoring you, and it is the thing a formal notice has to quantify.

Questions, answered

Is it free?

Yes, and nothing is stored.

Does this apply to consumers?

No. The directive covers business-to-business and business-to-public-authority debts.

Can I waive it?

You can choose not to claim it. You generally cannot be contractually forced to give it up in advance — that is the point of a statutory entitlement.

How do I claim it?

Name the figure in your final reminder, then in a formal notice. Both are here.
